The Circle - Terms and Conditions

1. Provider and Scope
The customer loyalty programme THE CIRCLE (the "Programme") is operated by NF Cosmetics GmbH, Tannenweg 36, 85399 Hallbergmoos, Germany, registered in the commercial register of the Local Court of Munich under HRB 285018, represented by its managing directors Natalie Bonetska and Thomas Hahn, e-mail: concierge@naturfactor.life ("NATURFACTOR").
These terms apply in addition to the General Terms and Conditions of the NATURFACTOR online shop. For participation in the Programme, these terms prevail.
2. Participation
Participation is free of charge. It begins when a customer account is created in the NATURFACTOR online shop; these terms are referenced when the account is created. They can be accessed and saved before account creation and remain available at this address at any time.
Participation is open to natural persons who are at least 18 years old, act as consumers within the meaning of § 13 of the German Civil Code (BGB) and are habitually resident in a country served by the NATURFACTOR online shop. Employees, staff and corporate officers of NF Cosmetics GmbH as well as persons purchasing goods in the course of their trade or self-employed professional activity, or for resale, are not eligible.
NATURFACTOR may refuse or terminate participation where there are concrete indications of abusive multiple registrations, automated registrations or other violations of these terms (see Section 6).
3. Earning Points

The registration bonus is granted once per person. Creating several customer accounts does not give rise to any claim to further registration bonuses.
The relevant goods value is the gross value of the eligible goods of an order actually payable after deduction of discounts and vouchers, excluding shipping costs. 5 points are credited for each full euro of this total goods value; cent amounts are disregarded. The value of the entire order is decisive, not the price of individual items (example: €34.90 → 34 full euros → 170 points).
For orders displayed or paid in another currency, points are calculated on the basis of the euro value assigned to the order in the shop system; deviations from the displayed foreign-currency amount may occur due to exchange rates.
Points are credited once payment has been received in full and can then be redeemed. No points are credited for the purchase of gift cards; where a gift card is used as a means of payment for eligible goods, points are credited on the relevant goods value under the general rules. Orders paid for under a product subscription also earn points under the general rules; the goods value actually charged for the respective subscription order is decisive.
Birthday bonus: Participants may voluntarily store the day and month of their birthday in the NATURFACTOR App to receive the annual birthday bonus. By activating this optional benefit, the provision of the birthday bonus becomes part of the participation agreement. Without the date, the birthday bonus cannot be granted; participation otherwise remains fully possible. The year of birth is not collected; the stored date is not used for advertising purposes.
The stored date can be changed once within twelve months and only with at least 30 days' notice; correction of an incorrectly stored date via customer service remains possible. If the birthday falls on 29 February, the credit is made on 28 February in non-leap years.
4. Viewing and Redeeming Points
The points balance and points history are displayed in the NATURFACTOR App, where points are also redeemed. The app is free of charge; a paid subscription is not required for participation in the Programme. The app is currently available for iOS. If redemption via the app is not possible for technical reasons or for lack of a compatible device, redemption can be arranged via customer service (concierge@naturfactor.life).
To allow the app to display the points you have earned in the shop, use the same e-mail address in the app as in your customer account.

100 points correspond to a redemption value of €1. Points are not legal tender; they can only be converted into discount codes in accordance with these terms and cannot be paid out in cash. They are non-transferable and do not bear interest.
Upon redemption, a personal discount code is generated. It is linked to your customer account, can be used once and is valid for 24 months from the day of issue. The specific expiry date is shown when the code is generated and thereafter displayed in the app. Conversion is final: the points used are deducted; after expiry the code can no longer be used and the points used are not returned. You will be informed of these consequences immediately before conversion.
The discount code can be redeemed where the goods value of the order, excluding shipping costs, is at least equal to the value of the code. It cannot be combined with other discount codes and does not reduce shipping costs.
5. Reversal: Cancellation, Withdrawal, Return, Refund
If an order is cancelled, withdrawn from, returned or refunded in whole or in part, the points credited for the affected goods value are reversed. The reversal uses the same calculation and rounding method as the original credit and is limited to the points originally credited for the order concerned. Refunds that did not earn points (in particular shipping costs) do not trigger a reversal.
Reversal after use of a discount code: If an order for which a THE CIRCLE discount code was used is reversed in full, NATURFACTOR will provide a new discount code with the original value. The new code is valid until the original expiry date; if fewer than 30 days remain at the time it is provided, it remains valid for 30 days from provision. In the event of a partial reversal, the discount used is apportioned between the retained and the returned goods in proportion to their original goods values; the portion of the discount attributable to the returned goods reduces the amount to be refunded. Your statutory rights, in particular the right of withdrawal, remain unaffected.
Negative points balance: If the participant has already used the points credited for an order that is later reversed, the reversal may result in a negative points balance. A negative points balance does not create any payment obligation and will not be claimed in money; it is exclusively offset against future points credits.
6. Abuse
Where there are concrete indications of a violation of these terms, NATURFACTOR may provisionally block the points concerned and ask the participant to comment. Points obtained without entitlement may be cancelled after review. Extraordinary termination of participation is only permissible in the event of serious violations or repeated violations despite a warning; no warning is required where it would be unreasonable. NATURFACTOR may correct obvious booking and system errors.
7. Expiry of Points
Points expire if, during a continuous period of 24 months, no new points have been finally credited and no points have been redeemed. Each such qualifying credit or redemption restarts the period for the entire existing points balance; reversals, cancellations, error corrections and purchases that are later fully reversed do not qualify.
NATURFACTOR will inform you at least 90 days before the intended expiry by e-mail to the address stored in your customer account. The relevant expiry date is also permanently displayed in the NATURFACTOR App. If a qualifying credit or redemption occurs before the expiry date, the announced expiry does not take effect. Expired points are not refunded.
8. Termination by the Participant
You may terminate your participation at any time in text form (e.g. by e-mail to concierge@naturfactor.life). Termination takes effect 14 days after receipt; until then, existing points can be redeemed. If redemption via the app is not possible for technical reasons or for lack of a compatible device, redemption can be arranged via customer service within this period.
Upon termination taking effect, unredeemed points expire; discount codes already generated remain valid until their expiry date. In the termination confirmation, NATURFACTOR will state the existing points balance, the effective date and the available redemption channels. Termination of Programme participation does not delete your customer account.
9. Changes to and Termination of the Programme
NATURFACTOR may amend these terms with effect for the future where there is a valid reason and the amendment is reasonable for participants, taking into account the interests of both parties. A valid reason exists in particular where the amendment is necessary to a) implement changed legal requirements or binding court or administrative decisions, b) eliminate security risks or demonstrable possibilities of abuse, c) adapt the Programme to technical changes of the online shop or the app, provided the essential content of the Programme is preserved, or d) close unintended regulatory gaps, provided the contractual balance is not materially shifted to the detriment of participants.
Changes to the earning rate, point values or requirements for future point credits apply exclusively to transactions after they take effect; the redemption value of points already earned will not be reduced retroactively. Changes will be communicated in text form at least six weeks before they take effect.
NATURFACTOR may terminate the Programme with three months' notice to the end of a month; termination will be communicated in text form. For twelve months after termination takes effect, points already earned can be redeemed at the redemption values applicable at the time of the announcement; thereafter, unredeemed points expire. The end date of the redemption period will be expressly stated in the notice. Discount codes already generated remain valid until their expiry date. The right to terminate for good cause remains unaffected.
10. Data Protection
To operate the Programme, NATURFACTOR processes your customer account data, the assignment of your orders (goods value, date) and your points balance and points transactions. The legal basis is Art. 6(1)(b) GDPR (performance of a contract).
The day and month of your birth are processed only if you activate the optional birthday bonus; this information is required to provide this Programme benefit. The year of birth is not collected. If the birthday bonus is deactivated, the stored date is deleted; point credits already made remain recorded as transactions.
Messages relating to the operation of the Programme (e.g. notice of upcoming point expiry) are not advertising and contain none. You will receive promotional messages only with separate consent; withdrawing that consent does not affect your participation or points. In all other respects, our privacy policy applies.
11. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection of mandatory provisions of the state of their habitual residence.
Should individual provisions be invalid, the validity of the remaining provisions remains unaffected. These terms are provided in German and English; in the event of discrepancies, the German version prevails.
