A. Cancellation Policy
Introduction
Consumers have a right of cancellation in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial activity nor to their self employed professional activity.
Right of cancellation
You have the right to cancel this contract within 30 days without giving any reason.
The cancellation period is 30 days from the day on which you or a third party nominated by you, who is not the carrier, took possession of the last goods.
By way of derogation, in the case of a contract for the regular delivery of goods over a specified period of time, the cancellation period is fourteen days from the day on which you or a third party nominated by you, who is not the carrier, took possession of the first goods.
To exercise your right of cancellation, you must inform us (NF Cosmetics GmbH, Tannenweg 36, 85399 Hallbergmoos, Germany, Tel.: +49 (0)155 63318056, Email: contact@naturfactor.life) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model cancellation form for this purpose, but this is not obligatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
Effects of cancellation
If you cancel this contract, we shall reimburse to you all payments received from you, including delivery costs (except for the additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we receive notification of your cancellation of this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In no event will you incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.
You shall send back the goods or hand them over to us without undue delay and in any event no later than fourteen days from the day on which you communicate your cancellation of this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You shall bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion or early expiry of the right of cancellation
The right of cancellation expires early in the case of contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
The right of cancellation does not apply to consumers who, at the time the contract is concluded, are not citizens of a Member State of the European Union and whose sole place of residence and delivery address at the time the contract is concluded are outside the European Union.
Linked financed transactions
If you finance this contract with a loan and later cancel it, you are no longer bound by the loan agreement either, provided that both contracts form an economic unit. This is particularly the case if we are also your lender or if your lender uses our involvement with regard to financing. If the loan has already been paid to us when the cancellation takes effect or when the goods are returned, your lender shall, in relation to you, assume our rights and obligations under the financed contract with regard to the legal consequences of the cancellation or return. This does not apply if this contract relates to the acquisition of financial instruments (e.g. securities, foreign exchange, or derivatives). If you wish to avoid a contractual commitment as far as possible, make use of your right of cancellation and also cancel the loan agreement if you are entitled to a right of cancellation for it as well.
General information
1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
2) Please do not return the goods to us carriage forward.
3) Please note that points 1 to 2 above are not a prerequisite for the effective exercise of the right of cancellation.
